1. Agreeing to these terms

These Terms of Use apply to beligator.com, its pages, and the Beligator waitlist (together, the “Site”), operated by Beligator, LLC (“Beligator,” “we,” “us”). By using the Site or joining the waitlist, you agree to these terms. If you don’t agree, please don’t use the Site.

When the Beligator app launches with accounts and subscriptions, it will have its own Terms of Service, which we’ll ask you to accept before using it.

2. Who can use the Site

You must be at least 18 years old to join the waitlist or use Beligator.

3. Information, not investment advice

Everything on the Site, including scores, rankings, ratings, track records, examples and articles, is general information for research and educational purposes only. It is not investment, financial, tax or legal advice, and it is not a recommendation or offer to buy, sell or hold any security, fund or crypto asset.

Beligator does not know your financial situation, goals or risk tolerance. You are solely responsible for your investment decisions. Consider talking with a qualified professional before making them.

Investing involves risk, including the loss of your entire investment. Past performance, whether real or simulated, does not guarantee future results.

4. Accuracy of information

We work to keep information on the Site accurate, but data comes from third parties and may be delayed, incomplete or wrong. Examples marked as sample data are for illustration only and do not describe real companies or results. We may change or remove content at any time without notice.

5. The waitlist and future services

Joining the waitlist doesn’t create an account or a subscription, and it doesn’t obligate you to buy anything. We may change, delay or decide not to launch any feature, plan or price described on the Site. Any founding-member or early-access offer will be described by email and is subject to the terms stated in that offer.

6. Acceptable use

When using the Site, you agree not to:

• copy, scrape, or automatically collect content or data from the Site;
• resell or republish Beligator scores or content without our written permission;
• interfere with the Site’s security or operation, or try to access systems you’re not authorized to use;
• use the Site for anything unlawful, misleading or harmful;
• sign up others for the waitlist without their permission.

7. Our content and brand

The Beligator name, logo, scores, methodology descriptions, text, graphics and design are owned by Beligator or its licensors and are protected by intellectual property laws. You may view and share links to the Site for personal, non-commercial use. Any other use requires our written permission.

8. Links to other websites

The Site may link to websites we don’t control, such as brokerages, exchanges or news sources. We’re not responsible for their content, products or privacy practices, and a link doesn’t mean we endorse them.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BELIGATOR AND ITS OWNERS, EMPLOYEES AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY INVESTMENT LOSSES OR LOST PROFITS, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100).

Some places don’t allow these limits, so they may not fully apply to you.

11. Indemnity

You agree to cover any claims, losses or costs (including reasonable legal fees) that arise from your misuse of the Site or your violation of these terms.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, unless the law where you live requires otherwise.

13. Changes to these terms

We may update these terms from time to time. We’ll change the effective date at the top, and if a change is significant, we’ll email waitlist members. Continuing to use the Site after an update means you accept the new terms.
